IRS disputes impact Americans across the country each and every year—and not in a good way! IRS disputes and penalties, in addition to their financial toll, can cause extreme stress—both mental and physical. IRS disputes can bankrupt businesses, destroy relationships, and make it seem impossible to simply live a “normal” life.

If you’ve dealt with IRS problems in the past, or if you’re currently facing them, you know exactly what we mean. But here’s some good news: there is a light at the end of the tunnel. No matter how dire your situation may appear, there is always hope. However, the problems won’t go away on their own. You must take action!

In fact, did you know that you may be able to avoid paying IRS penalties that you have been assessed? The craziness of life can make it easy to file late or make mistakes, which lead to penalties—but if you can provide a valid explanation, in many cases some or all of your penalties may be forgiven. Unfortunately, you are presumed guilty until proven innocent in the eyes of the IRS. And because the IRS is notoriously difficult to deal with, many Americans are afraid to plead their case. We don’t blame them! In fact, if not for our specialized training and our years of experience, we’d be hesitant to take on the monstrous bureaucracy that is the IRS as well!

The IRS has the authority to assess over 140 different types of penalties. The most common are the "failure to pay" and "failure to file".

When the IRS assesses penalties to taxpayers they are added automatically to the taxpayer's account by the IRS computer systems without taking into account the taxpayer's circumstances -- that is, why the tax was not paid or why the return was filed late.

At Polston Tax, we can help! We’ll guide you through the process of filing what is known as a penalty abatement request. This prompts the IRS to review the facts and circumstances surrounding the situation leading to assessment of the penalties. Relief is granted if the taxpayer exercised ordinary business care and prudence in determining their tax obligations but was unable to comply with those obligations. The existence of any of the following factors may establish reasonable cause:

  • Death, serious illness, or unavoidable absence;
  • Unable to obtain records;
  • Incorrect advice from the service;
  • Incorrect advice from a tax advisor;
  • Fire, casualty, natural disaster, or other disturbance;
  • Official disaster area; and
  • Service error.

If you’d like to explore your options regarding penalty abatement, call us confidentially or fill out our confidential contact form to schedule your FREE initial consultation.

Whether you are facing excessive penalties or IRS disputes of another nature, it’s important to understand that the IRS won’t leave you alone until you take action. Give us a call today and take the first step towards freedom from your IRS dispute!
